Disciplined in Sophisticated Defense and Insurance Litigation

Scott A. Hefner joined Butler in 2017 and is an Associate in our Charlotte office.  Scott focuses his practice on Subrogation and Recovery.  His litigation experiences are in medical malpractice defense, commercial disputes, catastrophic loss, construction defect, and products liability matters.

Scott graduated first in his class from North Carolina State University in 2005 with a Bachelor of Arts in Political Science.  He received his Doctor of Jurisprudence from the University of North Carolina at Chapel Hill in 2008.  While in law school, Scott served as a staff member and editor on the North Carolina Banking Institute Journal, was a member of the North Carolina Banking Institute Board of Advisors, and served on the Dean’s Advisory Counsel.

Prior to joining the firm, Scott clerked for the Honorable Ben F. Tennille of the North Carolina Business Court and practiced medical malpractice defense and general commercial litigation.

Carmack claims are unique animals.  Carmack provides a shipper—or its subrogating insurance company—with the sole remedy for damages sustained when goods are shipped between states.  As the sole remedy, it’s imperative that a claimant strictly comply with Carmack’s notice of claim requirements and any additional notice requirements outlined in the bill of lading.  As subrogation professionals, when a cargo claim comes in, the bill of lading should be the first document reviewed to determine what needs to be done—in addition to the five items listed below—to provide proper notice of the claim to the carrier.  Failure to file proper written notice will bar the claim.
