Disciplined in Sophisticated Defense and Insurance Litigation

Scott J. Frank is a Partner in the Tampa office of Butler. While Scott handles many cases from inception through the completion of trial, Scott’s practice is centered on civil trial litigation, specifically in state and federal courts.  This includes cases that are referred to Butler during the course of litigation, specifically in order to be brought to trial.

Scott is a Florida Board Certified Civil Trial attorney.  Board Certification is the highest level of evaluation provided by The Florida Bar regarding an attorney’s competence and experience within a specific area of law, and that attorney’s professionalism and ethics in the practice of law.  Less than 1.3% of the approximately 84,000 active lawyers in The Florida Bar have the designation of being a Florida Board Certified Civil Trial attorney.

During the more than 20 years that Scott has been with Butler, he has spent time focusing on cases in the areas of property coverage, subrogation (recovery and defense), and personal injury liability.  However, his litigation and trial practice includes cases involving First-Party Coverage, Third-Party Coverage, Product Liability Losses, Personal Injury Liability, Construction Litigation, Subrogation (recovery and defense), Bad Faith Litigation, Arson/Fraud Litigation, Commercial Litigation, Fair Debt Collection Practices Defense and Chinese Drywall Litigation.  Scott also works in our class action department.

Scott earned his law degree from the University of Miami in 1988. He worked diligently gaining 6 years of experience before ultimately joining Butler in 1994. Scott’s work takes him throughout the state of Florida, as well as having litigated cases in Alabama, Georgia, Kentucky, Louisiana, Michigan, Mississippi, New Jersey, North Carolina, South Carolina, Virginia, Puerto Rico, and the Caribbean.

The involvement of legal counsel to provide advice concerning the settlement of property and liability claims has become increasingly commonplace. This is primarily due to the general proliferation of litigation and specifically "bad-faith" claims. As the involvement of legal counsel becomes more prevalent, so does the "defense" of "advice of counsel." This commentary will address this so-called "defense" in the context of "bad-faith" cases.
