Emily C. Smith is a Senior Associate in Butler’s Miami office, working alongside the appellate practice team. Emily’s practice areas primarily involve liability defense, first-party property, and extra-contractual matters, as well as trial and general litigation support, in both state and federal courts.

Emily attended the University of Miami School of Law, graduating cum laude. While attending the University of Miami School of Law, Emily had the privilege of serving as an appellate intern to Chief Judge Juan Ramirez, Jr. Emily originally hails from the cornfields of rural Northern Illinois. She attended Roosevelt University in downtown Chicago, earning her Bachelor’s with top honors. After graduating, she worked as a theatrical lighting technician, stage manager, set designer, and general event production and staging technician.

Prior to joining Butler, Emily practiced extensively in Florida state and Federal Courts. In addition to her appellate experience, Emily’s trial court experience includes all aspects of litigation, from inception to jury verdict, on both the defense and plaintiff sides.

Emily’s diverse background, in both courtroom and law office settings, allows her to approach legal issues from a unique perspective, considering their many concurrent facets and nuances

Emily’s interests outside the office include traveling, sailing, biking, and camping.

  • Robinson Helicopter Co. v. Gangapersaud, 346 So.3d 134 (Fla. 2d DCA 2022), aff’d where, as a matter of first impression, the Florida appellate court applied new, controlling precedent created by the United States Supreme Court in Ford Motor Co. v. Montana Eighth Jud. Dist. Ct., 141 S.Ct. 1017 (2021), in analyzing due process for purposes of general and specific personal jurisdiction.
  • Other notable written opinions in the U.S. District Court and U.S. Eleventh Circuit Court of Appeal, as well as the Florida state District Courts of Appeal, involve matters ranging from civil rights, sovereign immunity, personal jurisdiction, contractual interpretation, duty to defend/indemnification, professional negligence, and premises liability and general negligence, among others.
