Emergency Order Regarding Hurricane Irma

September 18, 2017

On September 13, 2017, following Hurricane Irma, the Office of Insurance Regulation issued the attached Emergency Order. In short, the following is now ordered by the Commissioner of the Office of Insurance Regulation:

  1. For both personal residential and commercial residential properties-NO cancellations or non-renewals to a hurricane-damaged property for a period of 90 days AFTER the dwelling or residential property has been repaired.
  2. As to any policy or notice provision which imposes a time limit on an insured to do something or provide information, if that act was to have been performed on or after September 4, 2017…it has been extended to December 3, 2017. This would be for matters pending before Irma. (Please note if you have document requests pending, EUOs, and proof of loss requests).
  3. All notices of cancellation issued or mailed after August 25, 2017, shall be withdrawn and re-issued AFTER October 15th.

We recommend that you share this with your property team. If you have any questions, please do not hesitate to contact Jerry Albrecht or any of the Property Partners at Butler.
