George McMullin presented a webinar on How to Realistically Value and Enforce a Workers’ Compensation Carrier’s Lien Rights Under Florida Law. This program was intended to provide the subrogation professional with a general overview of resolving a workers’ compensation carrier’s subrogation rights as provided by Sec. 440.39 Fla. Stat. (2010). The program discussed the process necessary to properly protect the carrier’s lien rights both before and after the injured employee files suit against a third party tortfeasor, procedural and practical issues associated with filing suit in a carrier’s own name when/if permitted, determining a realistic settlement value for the carrier’s lien rights, and the equitable distribution hearing, should one be necessary.
