Partner Michael Savett was recently quoted in a Bloomberg article discussing a decision by the U.S. Court of Appeals for the Seventh Circuit which sets a precedent for insurers on crafting clearer policy language to avoid covering policyholders’ biometric privacy violations.
The US Court of Appeals for the Seventh Circuit identified vague insurance policy language that failed to exclude coverage for a policyholder accused of violating Illinois’ biometric privacy law. Carriers are likely to use this ruling as a guide to explicitly carve out data privacy offenses in their liability policies.
