Property Claim Ethics: Adjusting in Good Faith

Join Tampa Partner Tracy Jurgus and Chicago Partner Jon Barger as they present at the PLRB 2026 Claims Conference on March 24, 2026. They will provide attendees with a discussion of sources of ethical guidance, expectations, and/or requirements for property claims, as well as a role-playing, interactive discussion of recent case law from various jurisdictions. This course will next explore the ethics of commercial property claim adjustment through case studies in which a policyholder has alleged bad faith. This section of the presentation will be a role-playing, interactive discussion of recent case law from various jurisdictions. Next, there will be a role-playing discussion of the alleged acts of bad faith by the policyholder and the insurer’s defenses to those allegations. Jon and Tracy will role-play the roles of the policyholder’s counsel and the insurer’s counsel in presenting the arguments to the court. Participants will be asked to vote on how they think the court will or should rule on the motion.
