Avoiding Bad Faith by Using Statutory Interpleader in Multiple-Claimant Auto Claims

Tampa Partners David Krouk and James Shaw, Jr. will present a NAMIC webinar examining how statutory interpleader can be used in multiple-claimant auto matters. The program will address recent legal developments, practical considerations, and the circumstances in which interpleader may, or may not, be the appropriate approach. Drawing from their experience litigating some of the earliest cases filed under the new statute, David and James will discuss key considerations for using interpleader effectively, defensive strategies claimants may employ, the potential risks and protections introduced by the procedure, and the open questions and ambiguities that remain.

Attendees will also learn how interpleader actions may help insurers avoid bad-faith claims when multiple claimants are competing for policy limits that are insufficient to resolve all claims. The presentation will focus on Florida’s statutory creation of the procedure in 2023, its application in other jurisdictions, and the practical benefits it may offer in these matters. David and James will also address the procedure’s limitations and the unresolved issues that courts may ultimately be called upon to decide.
